Warranty Policy - CANADA

 

1. What warranties does UPS Battery Center, Ltd. (“we” or “us” or “our”) provide with my battery?

Every battery we sell comes with a free warranty (our “Free Warranty”). Our Free Warranty starts on the day you purchase your battery and extends for 1 year.

2. What does our Free Warranty cover?

We guarantee that our batteries are free of defects in material and workmanship.

3. Can I extend my warranty?

Yes. You can purchase an extended warranty (our “Extended Warranty”) that extends coverage for an additional 1 or 2 years after the Free Warranty expires. The Extended Warranty covers defects in material and workmanship.

4. What is not covered under our Free and Extended Warranties?

i. End of life. The Free and Extended Warranties (together, the “Warranties”) do not cover a battery reaching its normal end of life, which may occur prior to when the Warranties expire. A battery can deliver only a fixed number of usable charge cycles over its lifetime and is considered to have reached its normal end of life if the application uses up all of these charge cycles, regardless of the time the battery has been in service.

This means we reserve the right to deny a claim under the Warranties if we determine the battery has reached the end of its normal end of life, even if the claim is lodged within the applicable warranty period.

ii. Used batteries. The Warranties do not cover used batteries.

iii. Abuse and natural forces. The Warranties do not cover a battery that is damaged or destroyed as a result of one or more of the following: (a) willful abuse, misuse, physical damage, neglect or if the top decorative cover has been removed, (b)
 natural forces such as wind, lightning, hail; damage due to fire, collision, explosion, vandalism, theft, penetration or opening of the battery case in any manner, (c) overcharging, undercharging, charging or installing in reverse polarity, improper maintenance, allowing the battery to be deeply 
discharged via a parasitic load or mishandling of the battery such as but not limited to using the terminals for lifting or carrying the battery, (d) trickle chargers that do not have a regulated and appropriate trickle charge, (e) failure to properly install the battery or (f) repair or attempted repair of the battery unless expressly requested by our customer service team.

iv. Electrical qualities.  
Normal or accelerated deterioration in the electrical qualities due to operating or application conditions is not covered. 


v. Battery capacity. Coverage is void where the battery is used for an application that requires higher cranking power or a greater reserve rating than the battery is designed to deliver, or the battery capacity is less than the battery capacity specified by the product manufacturer, or the battery is otherwise used in applications for which it was not designed. 


vi. Improper cleaning. Coverage is void where there has been use of any type of oil, organic solvent, alcohol, detergent, strong acids, strong alkalis, petroleum-based solvents or ammonia solution to clean the battery covers and battery tops.  

5. If my battery is not working what should I do?

Please test the battery to determine whether it is malfunctioning or just needs a charge. If you believe the battery is not functioning as expected, please contact us and we will troubleshoot and try to fix the problem. If we can’t fix the problem we will issue a return authorization number and ship you a replacement that is the same or better. We'll also send you a FedEx Ground label so you can ship the problematic battery back to us at no charge.

Please note that we can't process any returns until you contact us and we issue a return authorization number.

6. If I receive a new battery under the Free Warranty or the Extended Warranty, do I get additional warranty coverage?

Batteries replaced under the Warranties only carry the remainder of the original warranty period. For example, if you purchase a battery on January 1, and we replace it six months later on June 31, your replacement battery’s warranty will extend for 6 months from June 31 to December 31.

7. Who decides whether there is a defect?

Determinations of whether there is a defect are made at our sole discretion. Our acceptance of any items shipped to us is not an admission that the items are defective.

8. What are the other limitations on the Warranties?

To the extent permitted by law, this limited warranty is in lieu of all other warranties including statutory or warranty of merchantability or fitness for a particular purpose. To the extent such warranties cannot be lawfully disclaimed, we limit the duration and remedies of such warranties to the duration and remedies of this warranty. Our exclusive liability for breach of warranty is to replace the battery within the warranty period. In no event will we be liable for any loss or damages of any other kind, whether direct, incidental, consequential, exemplary, special or otherwise. We are not liable for any removal or installation expense or loss of time or profits. This warranty shall be governed by and interpreted in accordance with the laws of the Province of Ontario without regard to the Province of Ontario conflicts of laws rules. The United Nations Convention on Contracts for the International Sale of Goods signed in Vienna in 1980 shall not apply to this warranty. No employee or representative of UPS Battery Center, Ltd. is authorized to make any warranty in addition to those made in this agreement.
